Purchasing investment gold in Hungary and Slovakia

Purchasing investment gold in Hungary and Slovakia

Legal differences and reporting obligations

Physical investment gold has been one of the most stable tools for protecting wealth and preserving value for thousands of years. Although the product itself—a gold bar or coin with a fineness of 999.9—is worth the same on international markets anywhere in the world, the legal and administrative framework for purchasing it can vary considerably from country to country.

In Central Europe, differences between the Hungarian and Slovak regulatory environments are leading more and more savers from Hungary to buy physical gold in Slovakia. Below, we compare the regulations currently in force in the two countries, purchaser discretion and the conditions for mandatory reporting.

1. The European Union foundation: VAT exemption

In both Hungary and Slovakia, the sale of investment gold is exempt from value added tax (VAT).

This uniform regulation is based on the European Union Directive on the common system of value added tax (Directive 2006/112/EC):

  • Investment gold: No VAT is payable on gold bars or wafers with a fineness of at least 995 thousandths, or on gold coins that meet the prescribed conditions.
  • Jewellery gold: Jewellery, by contrast, does not qualify as investment gold; it is made from alloys (usually 14- or 18-carat) and is subject to the full VAT rate in both countries.

The product’s tax classification is therefore the same, but there is a material difference in the administration accompanying the purchase and in the protection of privacy.

2. The Hungarian environment: central reporting and identification

Regulation of the precious-metals market in Hungary has tightened significantly in recent years. The law on preventing money laundering and terrorist financing (Pmt.), together with stricter provisions concerning the trade in precious metals, gives the state direct visibility into gold purchases.

  • Mandatory tax identification number (tax card):

In Hungary, dealers selling investment gold must request and record the purchaser’s personal data, including the natural person’s tax identification number (from their tax card).

  • Central reporting obligation:

Hungarian precious-metals dealers must provide the authorities with regular, itemised reports on purchases. This means that an official state record is created for every domestic gold transaction, linked to the purchaser’s identity.

  • Anonymity and discretion:

Because of the strict reporting protocol, purchasing investment gold in Hungary cannot remain fully discreet from state registration systems.

3. The Slovak environment: discretion and limits on authorities

Slovakia’s investment-gold market operates within a more flexible legal framework modelled on Western European practices (for example, those of Austria or Germany).

  • No mandatory request for a tax card:

Slovak regulations do not require a purchaser to provide a foreign or domestic tax identification number when buying gold.

  • No automatic reporting to the state:

Slovak dealers do not have to send an itemised, transaction-based list of purchasers to the Slovak state treasury or other bodies, and they do not send data to foreign authorities (for example, Hungarian tax authorities) either.

  • Anti-money-laundering legal framework (AML):

European anti-money-laundering principles also apply in Slovakia. There are statutory limits on large cash payments; however, when lawful payment methods are used (bank transfer or card payment), the purchaser’s data remain within the closed contractual relationship between the dealer and the purchaser, rather than becoming an item in a central state register.

5. Is it legal to buy gold abroad?

One of the European Union’s fundamental pillars is the free movement of goods and capital. As a Hungarian citizen, it is entirely lawful and legitimate to purchase investment gold in Slovakia (for example, in Štúrovo).

Good Delivery gold bars with a certificate, purchased in Slovakia with an invoice and official contract, can be converted into cash anywhere in the world at precisely the same world-market price as if they had been purchased domestically. The difference lies not in the quality of the precious metal, but in the peace of mind and discretion that the purchasing environment provides.
